One Barnet Judicial Review: Join us for the appeal hearing

We will be there in the court to support Maria Nash who fights the legal battle for us all.

 

Previous episode

On 7 May, the lawyers acting on behalf of Maria Nash lodged an appeal against the refusal to allow a Judicial Review of the One Barnet programme. The refusal had been on the technical grounds that the request for a Judicial Review was brought out of time.

The court has issued the appeal and it has been served to Barnet Council’s lawyers, to Capita and to the other parties.

The legal team is confident that the grounds for the appeal are promising. The appeal is based on the substantial endorsement of Judge Underhill of Maria Nash’s argument that Barnet Council had failed to consult residents about a fundamental change to the way Council services are delivered and governed, under the One Barnet outsourcing programme. Maria Nash was granted legal aid for the appeal and she is now waiting for a hearing date from the Court of Appeal.

The legal team will challenge the Judge’s ruling on delay, arguing that he has not followed a House of Lords ruling on what is meant by a “final decision”.

You should have received an update on the discussions from your staff group representative so please speak to them if you haven’t yet had this. A series of managers’ briefings have also taken place this week and your manager will be able to update you. Following the outcome of the Judicial Review we are now able to proceed with the democratic decision-making process for the DRS project. Council officers have completed a thorough evaluation or both bids submitted by Capita Symonds and EC Harris and this evaluation has gone to a review panel. A preferred bidder recommendation and the final business case will need to be taken through a series of Committee meetings for members to scrutinise and discuss before they take a decision. The final decision about whether there is a business case to proceed with the recommended preferred bidder will be made by Cabinet on 24 June 2013. The recommendation will be considered at Overview and Scrutiny Committee on 11 June and Cabinet’s decision will be considered at Overview and Scrutiny Committee on 3 July. Staff will know which bidder is the recommended preferred bidder on 20 May when papers for the pre-decision Overview and Scrutiny Committee are published. We will shortly send you an invitation to a staff briefing on this day via your AD or service lead. At this session you will hear which bidder is being recommended as the preferred bidder, how the recommended bidder will meet the objectives of the original business case and you will also have an opportunity to ask questions. The staff briefings will take place in Conference room 1 as follows on 20 May: 13.00 - 14.00 Cemetery & Crematorium Trading Standards & Licensing Environmental Health 14.15 – 15.15 Highways Network Management Highways Strategy and Traffic & Development Highways Transport & Regeneration Strategic Planning Regeneration 15.30 – 16.30 Building Control Land Charges Planning Development Management For any staff who are unable to attend on 20 May we will run extra sessions in the following weeks so that they will have an opportunity to hear the presentation and ask any questions they might have. Staff will have an opportunity to meet with the preferred bidder once the democratic process and formal procurement process is complete and mobilisation and consultation with the unions begins. We expect this to be sometime in mid-July.
